WP-16129-2021
(HITENDRA SHARMA Vs INDIAN RED CROSS SOCIETY M.P. STATE BRANCH AND OTHERS)
1
Jabalpur, Dated : 01-09-2021
Heard through Video Conferencing.
Shri D.K. Tripathi, learned counsel for the petitioner.
Shri Rahul Deshmukh, learned Panel Lawyer for the respondents/State.
Counsel appearing for the respondents submitted that writ petition filed by the petitioner is not maintainable as Indian Red Cross Society is a society
and not State within meaning of Article 12 of the Constitution of India. He relied on a judgment reported in ILR [2018] MP 894, New Balaji Chemist (M/s) vs Indian Red Cross Soceity and others.
Counsel for the petitioner prays for some time to go through the said judgment and to argue on maintainability of writ petition.
List the matter in next week.
