Shri P.C.Soni, learned counsel for the complainant. Heard on I.A.No. 31362/2021, an application under Section 320 read with Section 482 of Cr.P.c. for settlement of the case on the ground that appellant No. 2 and complainant are husband-wife.
Appellants faced trial for offence under Section 307, 498-A and 34 of IPC and convicted vide judgment dated 20/2/2015 to undergo various terms of sentences maximum of which is seven years RI each alongwith fine and default stipulation.
When this Court referred the judgment of Apex Court in the case of State of Madhya Pradesh Vs. Laxmi Narayan and Ors., (2019) 5 SCC 688 then counsel for the appellant sought withdrawal of application -I.A.No. 31362/2021 with liberty to raise all the grounds of settlement arrived at between the parties at the time of final arguments.
Prayer noted.
Application (I.A.No. 31362/2021) is dismissed as withdrawn. However, needless to say that appellants shall always have the liberty to raise all the grounds available to them at the time of final hearing.
Appeal being an admitted appeal, list for hearing in due course.
