Heard on the question of admission. Perused the impugned judgment.

Appeal involves arguable points, accordingly, it is admitted for final

hearing.

Als o heard on IA No.20758/2021, which is an application under Section 389(1) of Cr.P.C. for suspension of sentence and grant of bail on behalf of the appellants.

Appellants have been convicted and sentenced by judgment dated 30.09.021 passed by 19th Additional Sessions Judge, Bhopal in S.T.No.297/2017.

Learned counsel for the appellants submits that appellants were on bail during pendency of trial and after the impugned judgment, their jail sentence

are suspended by the court below till 29.11.2021.

Learned counsel for the respondent-State has opposed the application for suspension of sentence.

Considering the aforesaid and looking to the short term of sentence, IA No.20758/2021 is allowed. It is directed that remaining jail sentence of appellants shall remain suspended and they shall be released on bail on their furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each with a surety bond of like amount to the satisfaction of trial court concerned for their appearance before the Registry of this Court on 17/02/2022 and on such other dates as may be fixed by the Registry in this regard.

List the appeal for final hearing in due course.
