       Mr. Anil Shukla, learned Public Prosecutor for respondent/State.

Heard on I.A.No.31584/2021, first application u/Sec. 389(1) of Cr.P.C. for suspension of sentence and grant of bail filed on behalf of appellants.

T h is criminal appeal has been filed against the judgment dated

26.10.2021 passed in S.T.No.46/2014 by the Sessions Judge, District Bhind, whereby appellants have been convicted and sentenced under Section 323 and 323/34 of IPC for three months RI with fine of Rs.1,000/- each, with default stipulation.

Contention of counsel for the appellants is that the appellants were on bail during trial and they have not misused the liberty granted to them. Fine amount has already been deposited. Hearing of this appeal shall take some time. On these grounds, learned counsel for the appellants prays for suspension of sentence and grant of bail to the appellants.

Learned counsel for the State opposed the application and prayed for its rejection.

Considering the facts and circumstances of the case, but without commenting upon merits of the case, I0A.No.31584/2021 is allowed and it is directed that the jail sentence of appellants will remain under suspension subject to verification that amount of fine has been deposited, on appellants furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand Only) each with one solvent surety each of the like amount to the satisfaction of concerned Trial Court for their appearance before the Principal Registrar of

this Court on 25 th March, 2022 and on such further dates as may be fixed by the office in this regard.
