Further heard on I.A.No.19577/2021 filed on behalf of the appellant for suspension of jail sentence and grant of bail.

This criminal appeal has been preferred against the judgment dated 17.9.2021 passed by Additional Sessions Judge, Sagar District Sagar (M.P.) in S.T.No.157/2019 whereby the Court below has convicted the appellant for the offence punishable under Sections 427 and 435 of the IPC and sentenced him to undergo effective R.I for 3 years and a fine of Rs.1500/- with default stipulation.

Learned counsel for the appellant submits that the appellant was on bail during trial and his jail sentence has already been suspended by the trial Court till 17/11/2021. Hence prayer is made to suspend the jail sentence and release on bail.

Learned Panel Lawyer opposed the bail application. Having considered the arguments advanced by the learned counsel for the parties and looking to the other facts and circumstances of the case, this application (I.A. No.19577/2021) is allowed. It is ordered that subject to payment of fine amount, if not already deposited, the execution of jail sentence of the appellant shall remain suspended during the pendency of this appeal and he be released on bail on his furnishing a personal bond for a sum of 2 CRA-6575-2021

Rs.50,000/- (Rupees Fifty Thousand only) with one surety in the like amount to the satisfaction of the trial Court for his appearance before the Registry of this Court on 14.03.2022 and thereafter on all other such subsequent dates as may be fixed by the trial Court in this regard.
