The appeal being arguable is admitted. Let the record of court below be called for.
Vide present appeal under Section 372 of Code of Criminal Procedure, appellant seeks leave to file appeal against the judgment dated 27.01.2021 regarding acquittal of respondents from the charges under Section 323, 427,506-B, 34 of IPC.
In view of the judgment passed by the Hon'ble Supreme Court in the case of Mallikarjun Kodagali (Dead) through Legal Representatives Vs. State of Karnataka & others dated 12.10.2018 passed in Criminal Appeal No.1281-82 of 2018 (arising out of SLP (Cri.) No. 7040-7041 of 2014), presently no leave is required, instead the appeal under Section 372 of
Cr.P.C. filed at the instance of victim/complainant, alongwith the application is entertain and admitted for hearing.
Let bailable warrants in the sum of Rs.25,000/- (Twenty Five Thousand) each be issued against the respondents No.1 to 3 for securing their presence before this Court on a date to be fixed by the Registry of this Court.
