Shri S.K.Chaturvedi, learned counsel for the petitioner.
This writ petition has been filed against the order passed by the
Commissioner, Jabalpur, in his capacity as Arbitrator under Section 3(G)(5)
of the National Highways Act.
In our view, the remedy of the petitioner would be to approach the
Principal, Civil Court by filing objections under Section 34 of the Arbitration
and Conciliation Act, 1996.
Learned counsel for the petitioner prays for permission of withdrawal
of the petition to avail that remedy by relying on the judgment of the Supreme
Court for excluding the period of COVID for the purpose of computation of
the period of limitation .
The petition is disposed of as withdrawn with the aforesaid liberty.
