This petition has been filed for restoration of the First Appeal No.605/2012, which was filed against the ex parte judgment dated 11.5.2012 under section 9 of the Hindu Marriage Act.

The respondent/husband filed a petition under section 13 of the Hindu Marriage Act. The judgment was passed on 3.5.2016, against which First Appeal No.403/2016 has already been decided today by this Court. Because the dispute under section 13 of the Hindu Marriage Act has been decided, therefore, the decree under section 9 of the Hindu Marriage Act has become infructuous.

Hence, no order is required in this petition.

Accordingly, present MCC stands disposed of.
