Shri Praveen Dubey, learned counsel for the appellant citing the judgments of Hon'ble Supreme Court passed in the cases of P.K.

Ramchandran Iyer Vs. Union of India (1984)2 SCC 141 and Dr. Prabha Atri Vs. State of U.P. and Ors. (2003)1 SCC 701 submitted that the resignation letter submitted by the petitioner on 19.09.2017 was preceded by event of misbehavior with the petitioner by a customer and an earlier letter of resignation dated 03.09.2017 wherefrom the frustration of petitioner is clearly reflected. The said resignation was submitted in the background of aforementioned altercation which took-place in the bank between the petitioner and some public representative/customer (respondent No.5). He then wrote a letter to the Regional Manager of the Bank on 22.08.2017 asking

for police protection. Petitioner then maintained a perception that he is not receiving any co-operation from the Bank and asked his transfer to another Branch. In that state of mind, he tendered resignation.

Learned counsel for the appellant further submitted that appellant is an Ex-Army Personnel and he has served the Nation by working in the Indian Air Force for more than a decade and that he would be willing to re-join the services of the bank without any monitory benefit of the intervening period only on notional continuity of services.

In the opinion of this Court, learned counsel for respondents Shri Ashish Shroti should seek instruction from the respondents/bank on the aforesaid offer of the petitioner.
