(GAPPU KHAN NAI Vs KRISHI UPAJ MANDI SAMITI, GUNA AND OTHERS)

5
Gwalior, Dated : 02-07-2021
      Heard through Video Conferencing.
Shri Amit Lahoti, learned counsel for the appellant.
Shri S.P. Jain, learned counsel for the respondents.

I.A. No. 829/2021, an application for correction in order dated 22/01/2021, is taken up for consideration.

B y filing this application, it is prayed that a typographical error occurred in the order dated 22/01/2021 passed in this second appeal, may be corrected.

Learned counsel for the appellant submits that this second appeal has already been admitted for final hearing by this Court vide aforesaid order, but in the order "effect and operation of impugned judgment and decree shall remain stayed" has wrongly been typed in place of "parties are directed to maintain status quo with regard to property in dispute". Hence, learned counsel for the appellant has prayed to allow the aforesaid

application.

Learned counsel for the respondents does not oppose the prayer made by learned counsel for the appellant.

From perusal of the documents available on record, it appears that in the order dated 22/01/2021, due to typographical error, "effect and operation of impugned judgment and decree shall remain stayed" has wrongly been typed. Therefore, as the prayer is innocuous in nature, same is hereby allowed.

Accordingly, it is directed that in second page of order dated 22/01/2021 passed in this second appeal, "effect and operation of impugned judgment and decree shall remain stayed" be read as "parties are directed to maintain status quo with regard to property in 2 SA-45-2021 dispute".

With the aforesaid direction, I.A. No.829/2021 stands disposed of.
