Heard on IA No.27028/2021 which is an application for suspension of sentence and grant of bail.
Appellants have been convicted for the offence under Section 135 of
Electricity Act, 2003 and sentenced to undergo simple imprisonment for 3 months with fine of Rs.4,000/- each with default stipulation vide judgment dated 26.08.2021 passed by Special Judge, Electricity Act, District-Ujjain (MP) in Special Electricity Case No.1002551/2011 It is submitted by Counsel for the appellants that Court below has wrongly convicted the appellant. The Court below has not properly appreciated the evidence. The disposal of appeal will take a long time, hence, prayed for suspension of execution of jail sentence.
The prayer is opposed by Public Prosecutor for the respondent/State. It is directed that on depositing of fine amount, if not already deposited and on
furnishing personal bond for the sum of Rs. 30,000/- (Rupees Thirty Thousand Only) each with separate surety bond in the like amount to the satisfaction of the Trial Court for their appearance before the Registry of this Court on 07.02.2022 and on subsequent dates as may be fixed by the Registry of this Court, the appellant be released on bail and the substantive sentence under appeal shall remain suspended.
Accordingly, the IA No.27028/2021 stands disposed of. List this appeal for final hearing in due course along with record. Certified copy as per Rules.
