This third application under Section 439 of Cr.P.C. has been

filed for grant of bail. The second application was dismissed by order

dated 10.11.2021 passed in M.Cr.C.No.52931/2021.

The applicant has been arrested on 15.6.2021 in connection with

Crime No.354/2021 registered at Police Station Thatipur, District

Gwalior for offence under Sections 49(A) of Excise Act.

The second bail application was dismissed by a detailed order

dated 10.11.2021 passed in M.Cr.C.No.52931/2021 with liberty to

revive the prayer along with the status/judgments of 17 criminal cases

which were registered against the applicant. The present application

has been filed without complying the said condition. Since the

applicant is in jail for the last six months, therefore, this Court was

inclined to grant bail on furnishing cash surety.

It is submitted by Shri Sharma that the applicant is not in a

position to furnish cash surety and is not in a position to comply any

stringent condition.

Since the applicant has a criminal history and as many as 17

criminal cases have been registered against him and in view of the

criminal antecedents, the applicant is also not ready to abide by any

stringent condition, accordingly, no case is made out for grant of bail.

The application fails and is hereby dismissed.

However, liberty granted by this Court by order dated

10.11.2021 passed in M.Cr.C.No.52931/2021 to revive the prayer

along with the copies of the judgments/status of previously instituted

criminal cases would remain in force.
