Heard on the question of admission. Perused the impugned judgment.

Appeal appears to be arguable, therefore, it is admitted for final

hearing.

Also heard on I.A No.10677/2021, which is the first application for suspension of sentence and grant of bail to the appellant.

The appellant has been convicted under Section 420 and 471 of IPC and sentenced for RI five years with fine of Rs.1,000/-, in default of depositing the find amount further three months RI separately in both the counts, Learned counsel for the appellant submits that the amount of fine has already been deposited by the appellant and he is in jail for near about one

year and six months.

Although learned Panel Lawyer appearing for the respondent/ State opposes the prayer made by the counsel for the appellant but considering the fact that appeal would take time in its final disposal and period for which the appellant has already undergone without commenting anything on merits, I.A is allowed.

It is directed that remaining jail sentence of the appellant shall remain suspended and he shall be released on bail upon his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with a surety bond of like amount to the satisfaction of trial Court concerned for their appearance before the Registry of this Court on 04/04/2022 and on such other dates as may be fixed by the Registry in this regard.
