Heard on I.A.No.29360/2021, fourth application under Section
389 (1) of Cr.P.C. for suspension of sentence filed in respect of
appellant.
This criminal appeal assails the judgment dated 30.08.2019
passed in S.T.No.1500220/2016 by the II Additional Sessions Judge,
Bhind, whereby the appellant -Omprakash has been convicted under
Sections 467 of IPC and Section 468 of IPC and sentence to undergo
RI ten years with fine of Rs.5000/- and to undergo RI three years with
fine of Rs.5000/- respectively with default stipulations.
It is the submission of the learned counsel for the appellant that
the appellant has already suffered more than two years' incarceration,
out of total 10 years' conviction. Counsel for the appellant mainly
relied upon his age and medical ailment as according to him, appellant
is suffering from tongue cancer and under treatment at Jawahar Lal
Nehru Cancer Hospital, Bhopal which is reflected from the documents
submitted from the Officer, Central Jail, Bhopal. It is further submitted
that without calling hand writing expert, hand writing can not be
ascertained and therefore, the trial court erred in reaching the

conclusion about interpolation being performed by the appellant.
Hearing of this appeal shall take some time. Fine amount has already
been deposited. Appellant intends to perform some community service
to purge himself out of the guilt felt by the appellant and to serve
national/ environmental/social cause. Under these circumstances, he
prayed for suspension of the jail sentence of the appellant and grant
bail.
Learned Public Prosecutor for the State opposed the prayer and
prayed for its dismissal.
Heard the learned counsel for the parties and record perused.
Considering the overall facts and circumstance of the case,
without commenting on the merits of the case as there is no possibility
of early hearing of this criminal appeal before this Court, hence, I.A.
No.29360/2021 is allowed and it is ordered that on furnishing a
personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with
one solvent surety of the like amount to the satisfaction of the
concerned trial Court, appellant's jail sentence shall remain suspended
till disposal of this appeal and he be released on bail. The appellant is
further directed to remain present before the Registry of this Court on
04.03.2022
and, thereafter, on such subsequent dates as may be fixed
by the Registry.

It is expected from the appellant that he shall submit
photographs by downloading the mobile application (App)
prepared at the instance of High Court for monitoring the
plantation though satellite/Geo-tagging.
I.A.No.29360/2021 stands allowed and disposed of.
List the case alongwith Cr.A.No.8404/2019.
Copy of this order be sent to the trial Court concerned for
compliance.
