Shri Madan Singh, learned counsel for the respondent no. 2. Record of the trial Court is already received. Heard on I.A.No.15724/2021, an application for suspension of jail sentence and for grant of bail to the appellant.

This appeal has been preferred against the judgment dated 17.08.2021 passed by learned Special Judge, (SC/ST Act), Anuppur in SC ATR/50/2017, whereby the appellant has been convicted under Section 447 of IPC and sentenced to RI for three months and under Section 3 (1) (Cha) (Chha) of SC/ST (Prevention of Atrocities) Act and sentenced to RI for

one year with fine of Rs.1000/- with default stipulation.

Learned counsel submits that the trial Court has already suspended the jail sentence uptill 6.10.2021 and the amount of fine has already been deposited.

An early hearing of this appeal is not possible. Taking into consideration the facts and circumstances of the case, aforesaid I.A. is allowed.

It is, therefore, directed that if the appellant deposits the entire fine amount, if not already deposited and furnishes a personal bond in the sum of Rs.50,000/-(Rupees Fifty Thousand Only) with a solvent surety in the like amount to the satisfaction of trial Court for his appearance before the Registry of this Court on 20.12.2021 and on such subsequent dates as may be fixed in this regard, sentence of imprisonment awarded to him shall remain Signature Not Verified SAN
