Shri Nitin Agarwal, learned counsel for the intervenor. The present appeal under Section 100 of CPC has been preferred by the appellant against the judgment and decree dated 20.10.2015 passed by
IInd Additional District Judge, Guna in first Appeal No.71-A/2015 confirming the judgment and decree dated 12.07.2012 passed by the Civil Judge, Class- II, Guna in Civil Suit No.42-A/2010.
Heard on the question of admission. The appeal being arguable is admitted on the following substantial question of law:-
"i). Whether, first appellate Court was justified in dismissing the first appeal considering the some contents of the sale deed dated 27.05.1987(Ex. D-1).
(ii) Whether learned trial Court has committed a grave error of law while not considering the khasra entries in the year of 2011 and order dated 02.08.2011 passed by the Tahsildar, Guna."
As the respondents have already appeared and marked their presence, therefore, there is no need to issue notice to the respondents.
