already subject matter of adjudication in an appeal filed by the respondents. Petitioner, on the one hand, is avoiding hearing and not filing response in that proceeding and on the other hand, pursuing this matter which is not maintainable.
Counsel for petitioner prays for time to prepare the matter on the question of entertainability.
