Heard on IA.No.24992/2021, second application u/Sec. 389(1)

of Cr.P.C. for suspension of sentence and grant of bail filed on behalf of

appellant - Yuvraj.

This criminal appeal has been filed against the judgment dated

30.5.2014 passed in Sessions Trial No.116/2014 by the Second

Additional Sessions Judge, Distt. Guna, convicting the appellant under

Section 392 of IPC and sentencing him to undergo 7 years RI with a

fine of Rs.500/- with default stipulation.

It is submitted by learned counsel for the appellant that first

application for suspension of sentence of the appellant was allowed

vide order dated 7.1.2015 and the appellant was enlarged on bail, but

thereafter he remained absent on 19.8.2019 before the Registry, hence,

non-bailable warrant was issued and he was arrested on 18.6.2021. It is

further submitted that due to ailment appellant could not appear on the

said date. It is further submitted that he is in custody for the last two

months and final hearing of this appeal will take time. On such

premises, he prayed for suspension of sentence.

Learned counsel for the State opposed the application and prayed

for its rejection.

Considering the facts and circumstances of the case, but without

commenting upon merits of the case, IA.No.24992/2021 is allowed

and it is directed that jail sentence of appellant will remain under

suspension on appellant's furnishing bail bond of Rs.1,00,000/-

(Rupees One Lac Only) with one solvent surety of the like amount to

the satisfaction of concerned Trial Court for his appearance before the

Principal Registrar of this Court on 20th December, 2021 and on such

further dates as may be fixed by the office in this regard.
