Shri Amit Pandey, Panel Lawyer for the State. The matter is considered on the basis of PUD dated 24.03.2021 received from Jail Superintendent, Central Jail, Bhopal.

This appeal has been preferred by the appellant against the impugned judgment dated 11.05.2007 passed by Sixth Additional Judge, Jabalpur in ST No.393/2006 whereby the appellant has been convicted under Section 304 Part-II of IPC and sentenced to undergo RI for 7 years and fine of Rs.2000/- with default stipulations.

A s per the report dated 24.03.2021 received from Jail Superintendent, Central Jail, Bhopal, the appellant-Afzal Anna @ Afuzal has already been released from jail on 15.08.2010 in pursuance to order No.2324/2010 dated 11.08.2010 passed by the State Government,

Department of Jail, Bhopal.

In the aforesaid circumstances, no useful purpose will be served by entering into the merits of the case. Therefore, in view of the law laid down by the Apex Court in the case of Daya Singh Lohariya vs. State of Rajasthan (2007) 5 SCC 366 and by the Jharkhand High Court in the case o f Sarula Munda v s State of Bihar 2011 (3) Cr.L.J 3639 , without entering into the merits of the case, the appeal is dismissed having been rendered infructuous.

Let a copy of this order be sent to the jail authorities as well as to the concerned trial Court for information and necessary action.
