                                          Shri M. R. Sheikh, learned counsel for the petitioner.

                                          Petitioner; owner of a bus bearing registration No. MH 33 0514 has
                                   approached this Court under Article 226 of the Constitution of India with the sole
                                   grievance that his application for grant of stage carriage permit is pending
                                   consideration before respondent No.2 since 07.04.2021(Annexure P-3) and so far,

the same has not been adverted to. Hence, prays for a direction for early decision of

his application.

At this stage, learned counsel for the petitioner submits that on similar facts and circumstances, this Court while disposing of W.P. No.3529/2019 on 05/04/2019 has observed that respondent No.2 shall decide the application bearing in mind the provisions as contained in Rule 77 (1b) of the M.P. Motor Vehicle Rules, 1994 and the judgment rendered by the Co-ordinate Bench in W.P. No.7703/2018 (Waheed Khan Vs. Transport Department).

Prayer of the petitioner appears to be innocuous. Hence, the writ petition is disposed of with following directions;

(i) petitioner is directed to submit certified copy of the order passed today

before respondent No.2 within three working days from today;

(ii) respondent No.2 shall decide the application of the petitioner, if not already decided, bearing in mind the aforesaid provisions of law and the judgment as referred above, within a period of two weeks therefrom with no exception.

With the aforesaid directions, the writ petition stands disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case.
