Heard on IA No. 3536/2021, an application for withdrawal
the pending appeal.
This appeal has been filed under Section 19 of Family Court
Act against the order/judgment dated 23/03/2018 passed by Principal
Judge, Family Court Bhind (M.P.) in Case No. 252/2016
(matrimonial).
During pendency of this appeal, parties have entered into
compromise and in compliance thereof, respondent has deposited Rs.
3,50,000/- in CDR before the Family Court. This fact has not been
disputed by either of the parties.
In view of the aforesaid compromise, counsel for the
appellant is permitted to withdraw the appeal. Accordingly, the
appeal stands dismissed as withdrawn.
The Trial Court is directed to proceed in accordance with
terms and conditions.
