      I.A.No.11958/2021, ninth repeat interim application u/S.389(1)

Cr.P.C. has been filed by appellant Cheeku @ Sohan Singh seeking

temporary suspension of sentence to enable him to attend the 13th day

ceremony scheduled for 01/05/2021 arising out of death of his mother.

      Learned counsel for the State has submitted that in compliance

of the order dated 23/4/2021, verification report has been received

wherein it is mentioned that the mother of the appellant has died on

18/4/2021

and the 13th day ceremony is scheduled on 01/5/2021.

In view of the above, I.A.No.11958/2021 stands hereby allowed

and it is directed that jail sentence of appellant Cheeku @ Sohan

Singh shall remain temporarily suspended and he be released

forthwith on bail on his furnishing personal bond in the sum of

Rs.1,00,000/- (Rs. One Lakh only) with one solvent surety of the like

amount to the satisfaction of CJM concerned provided that the

appellant shall surrender himself to custody before the CJM on

05/05/2021 for undergoing the remaining part of jail sentence as per

the impugned judgment.

Appellant Cheeku is further directed to mark his presence

daily till 04/5/2021 in the nearby police station and SHO of the

concerned police station is directed to file the attendance report of

the appellant before the CJM concerned.

Let the case be taken up on 07/05/2021 for appellant Cheeku to

file proof that he has surrendered before the CJM concerned in

compliance of the above direction.
