Heard on I.A.No.1229/2021, an application under section 389(1) Cr.P.C., seeking suspension of sentence and grant of bail filed on behalf of appellant.

During the course of the arguments, learned counsel for the appellant brought to notice of this Court that in Para - 7 of the judgment the table drawn has shown an amount of Rs.41,28,348/- which is deposited in the appellant's account whereas actual amount deposited in his account was nearly Rs.28,00,000/-.

This Court refrains from commenting upon this and there is nothing on record to suggest that at any point of time such alleged discrepancies was sought to be reviewed in the court below.

At this stage, learned counsel for the appellant seeks to withdraw I.A. No.1229/2021 with liberty to take recourse to law before appropriate forum. He may do so unless law prohibits.

I.A. No.1229/2021 is, accordingly, dismissed as withdrawn.
