JUDGMENT
The petitioner is a cashew exporter under the
name and style of M/s.Kailas Cashew Exports. There was
a electrical connection with Consumer Code:LCN 19/5676
with High-Tension Supply. Since there was default in
payment of electricity charges, Ext.P1 order was issued,
which shows the balance to be recovered is Rs.9,96,603/-
as on 09.01.2024 and the revenue recovery proceedings
were initiated against the petitioner.
2. The learned Standing Counsel for the
respondents on instructions submitted that the total
amount outstanding as on today is Rs.10,76,408/-.
3. The petitioner seeks indulgence of this
Court to grant instalments to pay the outstanding amount.
Having heard the counsel appearing for the
petitioner as well as the learned Standing Counsel
2024:KER:70384 appearing for the respondents 1 and 3, I deem it
appropriate to dispose of the writ petition as follows:-
(i) The petitioner shall pay an amount of
Rs.1,00,000/- (Rupees One Lakhs only) within a period of
one month and the balance amount in nine equal monthly
instalments with all interest and allied charges.
(ii) The first instalment is to be paid on or
before 07.11.2024, and the remaining eight installments
on or before the 7th day of each succeeding month.
(iii) In case of failure in making the lump sum
payment or any installment as directed above, 1st
respondent shall be free to proceed against the petitioner
in accordance with the law.
(vi) Till such time, all coercive proceedings
against the petitioner shall be deferred.
