ORDER
This review petition has been filed by the appellant in
R.F.A.No.176/2004 for review of the judgment dated 01/12/2023
alleging errors apparent on the face of the record. It is alleged that
though several contentions had been raised in the appeal
memorandum, this Court failed to consider the same and therefore
the judgment dated 01/12/2023 requires to be reviewed.
2. Heard both sides
3. This Court in paragraph 7 of the judgment has stated
that though several grounds of challenge had been raised against
the impugned judgment, the only challenge made during the
course of arguments was regarding the identity of the disputed
property and hence the reason why this Court confined its finding
R.P. No.564 of 2024 in
to the said aspect. The said findings or conclusions are not vitiated
by any error(s) calling for a review, as an order can be reviewed by
a court only on the grounds mentioned in Order XLVII Rule 1.
The powers of review cannot be exercised as an inherent power
nor can an appellate power be exercised in the guise of power of
review. [Shri Ram Sahu v. Vinod Kumar Rawat, (2021) 13 SCC
1]. Hence, this review petition is liable to be dismissed and I do
so.
Interlocutory applications, if any pending, shall stand
closed.
