JUDGMENT
Petitioner has filed an application as
C.M.P.No.81/2024 claiming protection and to prosecute the
accused under Section 195A of the Indian Penal Code,
1860. Petitioner alleges that she is a defacto complainant in
C.C.No.322/2022 and is a widow with a mentally
challenged child.
2. Though the petitioner's claim in C.M.P.No.81/2024
in C.C.No.322/2022 before the Judicial First Class
Magistrate's Court-I, Mavelikkara is not properly worded, it
is understood from the submissions of the counsel for the
petitioner that the intention behind the said petition is to
claim the benefit as a measure of witness protection. It was
submitted that despite police protection having been
granted, the accused is threatening the petitioner to give
false evidence before the Court. OP(CRL.) NO. 188 OF 2024
3. In such circumstances, the learned Magistrate shall
consider and pass appropriate orders on C.M.P.No.81/2024
in C.C.No.322/2022 as expeditiously as possible, in a time-
bound manner, bearing in mind, the principles of the
Witness Protection Scheme 2018.
This original petition is disposed of.
