This Contempt of court case (civil) having come up for orders on
24.05.2023, the court on the same day passed the following:

                                                           P.T.O.

                    -------------------------------------
                  Con. Case (C.) No. 494 of 2023
                 -------------------------------------------
Dated this the 24th day of May, 2023

                                  ORDER

Sri. U. Balagangadharan, the learned counsel appearing for the

petitioner, submits that by judgment dated 15.09.2022, this Court had

declared that the petitioner is entitled to be promoted and appointed as

Head Master of Pantheerankavu Higher Secondary School with effect from

01.06.2021. Directions were also issued to the 5th respondent to forward

the proposal for the appointment of the petitioner as Head Master of the

school with effect from 01.06.2021, and directions were issued to the 4th

respondent to pass appropriate orders within a further period of four weeks.

It is pointed out that though the matter was taken up in appeal by

preferring W.A. No. 1508/2022, a Division Bench of this Court had refused to

grant any order of stay. It was, however, observed that the pendency of the

appeal will not preclude the competent authority from considering the claim

of the petitioner for promotion to the post of Head Master if he is otherwise

entitled to such promotion.

Con. Case No. 494 of 2023

The learned counsel points out that despite the lapse of several

months, and though the petitioner is due to attain superannuation on

31.05.2023, no orders have been passed.

If orders are not passed on or before 30.05.2023, the 4th respondent

shall appear in person before this Court to answer why he shall not be

proceeded against for flouting the directions issued.
