This contempt case is filed alleging non-compliance of
the directions in the judgment in WA No.500 of 2021 dated
15.11.2021
On going through the averments in the contempt case,
we had directed the respondent to file an affidavit. Accordingly, an
affidavit was filed on 01.01.2022 refuting the allegations in the
case. To bring in more clarity a fresh affidavit was filed on
01.02.2022 detailing the proposed steps and mentioning the time
line as well. On going through the proposal with the time
schedule, we feel that the respondent cannot be seen as violating
the conditions in our judgment dated 15.11.2021. Accordingly, we
close the contempt case making it clear that the petitioner will be
free to raise all the legal contentions available to him before the
enquiry officer at the appropriate stage during the proceedings, in
tune with the directions in our judgment dated 15.11.2021 in WA
No.500 of 2021. In the light of the time line stated in the affidavit C.O(C) No.2188 of 2021
filed on 01.02.2022, we deem it fit to extend the time granted in
the judgment dated 15.11.2021 for completion of the proceedings.
Accordingly, the contempt case is closed.
