These appeals are filed by State of Kerala and
University of Kerala challenging the judgment of the learned
Single Judge. The question of law that was considered was
regarding the application of the reservation in teaching
posts in Universities as a single unit. The learned Single
Judge has struck down the amendment to Kerala University
Act. As appointments have already been made pursuant to the
above statutory provisions by applying the reservation, the
operation of the judgment would have far reaching
consequences upon the teachers appointed by the University.
In such circumstances, it is appropriate to stay the
operation of the judgment for a period of three months.
2. Learned Advocate General, learned Standing Counsel
for the University and the learned senior counsel appearing
for the party respondents agreed for an early hearing on
12/7/2021 subject to the convenience of the Bench having the
roster.
