Dated this the 14th day of July, 2021
ORDER
Bechu Kurian Thomas, J.
We had by our order dated 27.11.2020 in RP.No.911 of 2020
in OP (FC) No.207 of 2020 and R.P.No.913 of 2020 in O.P.(F.C) No.206 of
2020 directed OP (HMA) No.57/2018 and OP.No.809/2018 pending
before the Family Court, Chavara to be disposed of within a period of 12
months from 23.06.2020.
2. By letter dated 05.07.2021, the learned Family Court
Judge has requested for a further period of one year to dispose of the
above referred petitions. Reference is made to the disinclination of the
parties to adduce evidence, failure to carry out the amendment within
time, the lock down imposed and also the transfer of the Presiding
Officer as reasons for enlargement of time.
On a perusal of the request, we are satisfied that the time
prescribed in our order dated 27.11.2020 is required to be extended.
However, having regard to the circumstances of the case, we deem it
appropriate to extend the time for disposal of OP (HMA) No.57/2018 RP No.911/2020 3/3
R.P.Nos.911 of 2020 & 913 of 2020
and OP.No.809/2018 by a further period of six months from today. It is
also clarified that if in case the pleadings are not completed by the
parties within a period of four weeks from today, the Family Court will be
free to proceed in accordance with law, without further delay.
