     Application praying that in the circumstances stated in
the affidavit filed therewith the High Court be pleased to
stay the passing of final decree pursuant to the judgment and
decree dated 23.09.2020 in AS.No.11 of 2016 on the files of
Sub Court,Perumbavoor,and the judgment and decree in
OS.17/2014 on the files of the Munsiff's Court, Kolenchery,
pending disposal of this Appeal.


     This application coming on for orders upon perusing the
application and the affidavit filed in support thereof,and
upon hearing the arguments of M/s GIRIJA K GOPAL & K.N.VIGY,
Advocates for the petitioners and of SRI.RADHAKRISHNA

For information purpose only Heard the learned counsel for the appellant and the learned counsel for the 1st

respondent.

2. This R.S.A. is admitted on the following substantial questions of law:-

i. Whether the trial court discarded the order issued by the maintenance tribunal and Revenue Divisional Officer, Muvattupuzha on 13.2.2012 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 cancelling the settlement deed No.6153/2011 dated 11.11.2011 of Sub Registrar's Office, Puthencruz which was executed by Kunjipilla Amma in favour of Gopalakrishnan?

ii. Whether the two courts below appreciated the evidence regarding the execution of Ext.B1 Will in the light of Section 68 of the Indian Evidence Act and Section 63 of the Indian Succession Act?

iii. Whether the trial court disallowed I.A.No.606/2015 praying to recall DWs.2 and 3 for clarification regarding the execution of the Will on technical grounds?

Issue notice to the respondents 2 to 12.

Passing of final decree pursuant to the judgment and decree dated 23.9.2020

in A.S.No.11/2016 on the file of the Sub Court, Perumbavoor which arose from

the judgment and decree in O.S.No.17/2014 on the file of the Munsiff's Court,
