P/U/S.498-A, 504, 506 OF IPC AND SEC.3, 4 OF DP ACT.

     THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
THE COURT MADE THE FOLLOWING:
                             ORDER

Learned High Court Government Pleader accepts notice

for respondent No.1-State.

Dr.M.Sunil Sastry, learned counsel appeared for

respondent No.2.

Office objection is overruled.

This petition is filed by the petitioner-accused No.1 under

Section 482 of Cr.P.C. for quashing the criminal proceedings in

C.C.No.51972/2019 arising out of Crime No.219/2018

registered by Jeevan Bheemanagar Police Station, Bengaluru

and charge sheeted for the offence punishable under Sections

498A, 504, 506 read with Section 34 of Indian Penal Code,

1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

2. During pendency of the petition, both petitioner and

respondent No.2 appeared before the Court along with their

counsels and filed joint compromise application on

I.A.No.1/2024 under Section 320 read with Section 482 of

Cr.P.C.

3. Learned counsel submits that the matter has been

settled before the Mediation Centre in the matrimonial case and

it is a final settlement. The petitioner handing over the D.D. for

Rs.20,00,000/- as full and final settlement to the respondent

No.2. The same is received and acknowledged by the

respondent No.2.

4. In view of the judgment of the Hon'ble Supreme

Court in the case of Gian Singh vs. State of Punjab and

Another reported in 2012 CRI.L.J.4934 wherein, it has

been held that in cases where the parties have settled the

dispute between them in respect of a matrimonial case, the

Court can quash the proceedings.

5. Accordingly, I.A.No.1/2024 is allowed. The parties

are permitted to compound the offence and consequently, the

criminal petition is allowed.

The criminal proceedings against the petitioner-accused

No.1 in C.C.No.51972/2019 arising out of Crime No.219/2018

registered by Jeevan Bheemanagar Police Station, Bengaluru is

hereby quashed.
