ORAL ORDER
The petitioners have all sought for a declaration that they
are employees of the State Government within the meaning of

Rule 2A of the Karnataka Civil Services Rules (henceforth
referred to as 'KCSR' for short) and therefore, they are entitled
to pension under Rule 285 of KCSR. Alternatively, they have
sought for a direction to the respondent No.1 to grant them
pension on par with the employees under the 'Triple Benefit
Scheme' granted to the grant-in-aid institutions under the
Karnataka Education Act, 1983.
2. The petitioners contend that they were all
employees of respondent No.4 which is an autonomous body
constituted by the State Government in terms of an order
dated 16.07.1980. The respondent No.4 had its budgetary
grants in the form of grant-in-aid by the State Government
towards salary, wages and other expenses. Therefore, they
contend that the respondent No.4 was under the direct control
of the respondent No.1 and was part of department of
respondent No.2. They further contend that a perusal of the
memorandum of association of respondent No.4, established
that it was an instrumentality of State under Article 12 of the
Constitution of India. They contend that their representation
dated 14.11.2000 for grant of pension, was placed before the
respondent No.3/governing council of respondent No.4 which

took a decision to place it before the respondent No.1. The
respondent No.1 in terms of its letter dated 15.01.2001 sought
for certain clarification regarding the proposal submitted by the
respondent No.3 for grant of pension to the employees of
respondent No.4. The clarification sought for was submitted to
the respondent No.1. Later the respondent No.1 informed the
respondent No.3 by letter dated 25.02.2002 that grant of
pensionary benefits under KCSR may not be proper, as
employees of respondent No.4 were admitted to salary grant
and in case pensionary benefits were granted under KCSR,
similarly placed institutions would make a similar demand
which would impact the finance of the respondent No.1. It
therefore, directed the respondent No.4 to have a provident
fund scheme. On 05.10.2002, the respondent No.3 submitted
yet another proposal stating that respondent No.4 was
established in the year 1981 with the assistance of the World
bank and that the employees of the institution were granted
pay scale on par with the Government employees and that the
institute was fully controlled by the State Government and was
part of the Department of Sericulture. They claimed that grant
of pensionary benefit under KCSR would not burden the

Government with any additional expenditure, but on the
contrary, the State Government would be saving the
contribution made to the provident fund. Therefore, it
requested the respondent No.1 to reconsider its earlier decision
not to grant the benefit of pension under KCSR. The respondent
No.1 again in terms of its order dated 01.04.2003 informed the
respondent No.4 to work out a fund and formulate a scheme
with the help of an insurance company. The respondent No.4
again escalated the demand of its employees for grant of
pension by submitting a fresh proposal to the respondent No.1
on 08.04.2004 regarding a pension scheme to be framed and
sought approval of the Government. The respondent No.1 in
terms of a letter dated 30.08.2004, informed the respondent
No.4 that in view of its earlier decision, question of
reconsidering the issue did not arise and thus rejected the
proposal. The respondent No.4 once again submitted a
proposal seeking absorption of the entire institution to the
Department of Sericulture and to grant pensionary benefits on
par with the Government servants. This proposal was also
rejected by the respondent No.1 stating that the respondent
No.4 being an autonomous institution, its employees cannot be

treated as Government servants and therefore, the benefit of
KCSR cannot be extended. Being aggrieved by the said
communication dated 14.10.2010, the petitioners have filed
this writ petition.
3. The learned counsel for the petitioners submitted
that the respondent No.4 is comprised of the Secretary,
Commerce and Industries Department, Finance Secretary of
the State Government, Director of Sericulture, Bengaluru,
Professor of Zoology, Bengaluru University, Director, Central
Sericultural Research and Training Institute, Mysore, and
Director, Karnataka State Sericulture Development Institution,
Bengaluru. He submits that the respondent No.4 is fully
controlled by the State Government. Besides this, he submits
that the respondent No.4 is fully funded by the State
Government and therefore, for all practical purposes, the
respondent No.4 is a department of respondent No.3 and
hence, the petitioners are to be treated as the servants of the
Government and are to be treated as Government servants for
the purpose of KCSR. He contends that Rule 2A of KCSR,
provides as follows:

"2A. Application of Rule 285.-
Notwithstanding anything contained in Rule 2, Rule 285 shall, with effect from 16th March, 1970, apply to all persons serving in connection with the affairs of the State of Karnataka including persons allotted or deemed to be allotted to serve in connection with the affairs of the State of Karnataka under Section 115 of the States Reorganization Act, 1956".
He then referred to Rule 285 of KCSR, which reads as
follows:
"285. Retiring pension:- A retiring pension is a pension granted to a Government servant,
(a) who is permitted to retire any time after completion of a qualifying service of not less than 15 years subject to the conditions specified in sub-rule (2) hereunder; or
(b) who is permitted to retire any time on attaining the age of 50 years, subject to the conditions specified under sub-rule (3) hereunder; or
(c) who is retired in public interest any time after completion of 20 years of qualifying service or after he has attained the age of 50 years subject to sub-rule (4) thereunder."

Thus, he contends that if the petitioners are treated as
Government servants, they too are entitled to be treated on par
with the Government servants in the matters of grant of
pension. He further submits that the respondent Nos.3 and 4
have recommended the employees of respondent No.4 to be
treated as Government servants and to apply the provisions of
KCSR in the matters relating to grant of pension. Therefore, the
petitioners are entitled to be treated on par with the
Government servants. He further contended that the Cadre and
Recruitment Rules of respondent No.4 specifically provided that
the provisions of KCSR 1958, Karnataka Civil Service (Conduct)
Rules, 1966 and Karnataka State Civil Services (Classification,
Control and Appeal) Rules, 1957 and all other service rules
applicable to the officers of the Government shall in so far as
they are related and applicable to employees of the KSSRDI are
adopted for application to the employees of the KSSRDI
provided such rules are not incorporated in the Bye-laws of
KSSRDI. He therefore, contends that the respondent No.4 has
itself adopted the provisions of KCSR, 1958 and therefore, the
employees of the respondent No.4 had to be treated as
Government servants atleast for the purpose of grant of

pension. He contends that in a similar case, the Karnataka Silk
Filature Factory, was taken over by the Karnataka State Silk
Industries Corporation and question arose whether those
employees were also Government servants for the purpose of
grant of pension. In that case, the tribunal considered the
question whether employees who were erstwhile employees of
a Government company which were taken over by the
Karnataka State Silk Industries Corporation were entitled to
grant of pension and it held that such employees were also
serving the State Government for the purpose of Rule 285 of
KCSR and held that they too were entitled to be treated as
Government Servants for the purpose of grant of pension. The
learned counsel contended that the judgment of Karnataka
Administrative Tribunal was upheld by this Court and the State
Government in terms of its order dated 29.09.2010 granted the
pension to all those persons who were parties before the
tribunal. He therefore, contends that the petitioners too are
similarly situated and hence, they are to be granted the benefit
of pension as applicable to the Government servants.
4. Per contra, the learned counsel for the respondent
No.2 has filed statement of objections contending that the

respondent No.4 is an autonomous institution established by
the State Government and that the petitioners are all
employees of respondent No.4 and their service conditions are
exclusively governed by the Cadre and Recruitment Rules.
Therefore, it contended that the service benefits that are made
available to the Government servants cannot be extended to
the petitioners. It further contended that the respondent No.4
is not an extension of department of respondent No.3, but the
respondent No.3 draws benefit from research findings of the
respondent No.4 for its extension activities. It also contended
that the respondent No.4 is granted aid by the respondent No.1
but that does not necessarily mean that the respondent No.4 is
a Government institute and therefore, the employees of
respondent no.4 cannot be treated as Government employees.
It further contended that the claim of the petitioners that they
should be treated on par with the employees of Karnataka
State Filature Factory is unfair, as the petitioners were
governed under the Employees Provident Fund Scheme of the
Government of India and the management of respondent No.4
was paying an equal contribution every month in respect of the
petitioners which were credited into their respective accounts

and therefore, the petitioners cannot have a double benefit of
provident fund and pension. With these contentions, it claimed
that the petitioners are not entitled for any reliefs sought for in
the writ petition.
5. The learned Additional Advocate General
representing the respondent No.1 submitted that the judgment
relied upon by the learned counsel for the petitioner in
Application Nos.6723 to 6727/2004 c/w Application No.4195 to
4233/2005 rendered by the Karnataka State Administrative
Tribunal, Bengaluru is not applicable to the facts and
circumstances of the case, in as much as, in that case what
was in issue was whether those employees who were erstwhile
employees of the State Government and who are later on
handed over to an autonomous body could be deprived of the
right to claim pension. He submitted that in the present case
the facts are entirely different in as much as, all the petitioners
were recruited by the respondent No.4 and all of them were
subject to its Cadre and Recruitment Rules. He submitted that
the very same question came up before the Division Bench of
this Court in W.P.No.8906/2021 c/w 8030/2020 where the
Division Bench of this Court held that "there is no dispute with

regard to the fact that applicants herein were directly appointed
by KSIC. Therefore, State Government's contention that
applicants are not entitled for pension merits consideration. It
further held that "We may record that the applicants had an
option to choose, whether to be governed under the State
Government or the KSIC. Applicants are chosen to be
governed by the KSIC. Once, they have exercised their option,
they cannot claim the benefits available to those who are
governed by the State Government Rules. It is also an
undisputed fact that the applicants have availed Contributory
Provident Fund benefits available to them under the KSIC
Scheme. Hence, they are estopped from claiming pensionary
benefits from the State Government." He also relied upon the
judgment of the Hon'ble Apex Court in the case of U.P.
Roadways Retired Officials and Officers Association Vs.
State of U.P. and Another - 2024 SCC Online SC 1818,
where the Hon'ble Apex Court held that "the High Court, under
the impugned judgment, has observed that the appellants
having received retiral benefits including the benefit under the
Employees Provident Fund Scheme, cannot be permitted to
turn around and contend that they should also be given

pension. We have also considered this aspect of the matter and
we approve the observations of the High Court on the principle
that a party to the litigation cannot be permitted to approbate
or reprobate."
The learned Additional Advocate General submits that the
petitioners having once subscribed to a Employees Provident
Fund Scheme, cannot now turn around and claim that they are
to be treated as Government servants and that they are
entitled to pension on par with the Government servants.
6. The learned counsel for the respondent No.4 has
placed on record the Karnataka State Sericulture Development
Institute Contributory Provident Fund Regulations. As per
Regulation 3, Sub Regulation II, a 'Member' means "any person
in the service of the Institute either at Head Office or elsewhere
who has been duly admitted as subscriber to the Karnataka
State Sericulture Development Institute Contributory Provident
Fund. The respondent No.4 has constituted a trust, evidenced
by a deed entered into between the respondent No.4 and
several officers of the State Government and contemplated a
fund known as "Karnataka State Sericulture Development

Institute Employees Provident Fund" for the benefit of its
employees. The trust so constituted operates the fund
contributed by the respondent No.4 as well as the employees of
respondent No.4. The learned counsel therefore contends that
the Cadre and Recruitment Rules relied upon by the learned
counsel for the petitioners has to be read in light of the
Karnataka State Sericulture Development Institute Contributory
Fund Regulations. He contends that what is not provided under
the rules framed by the respondent No.4, could be borrowed
from KCSR, 1958 and that therefore Rule 285 of KCSR is
inapplicable to the petitioners. He contends that the petitioners
have all contributed to the fund and hence, they cannot now
turn around and claim that they are entitled for a pension on
par with the employees of the State Government.
7. I have considered the submissions of the learned
counsel for the petitioners as well as the learned counsel for
the respondent No.4 and learned Additional Advocate General.
8. It is not in dispute that the petitioners are all
employees who were regularly recruited by respondent No.4
and were governed by Cadre and Recruitment Rules. Rule 33 of

Cadre and Recruitment Rules relied upon by the learned
counsel for the petitioners which is referred supra, applied only
"in so far as they are related and applicable to employees of
the KSSRDI". Therefore, when the petitioners had admittedly
subscribed to a Provident Fund Scheme under the Karnataka
State Sericulture Development Institute Contributory Provident
Fund Regulations, 1982, and had contributed towards the fund
and when the respondent No.4 had also contributed to an equal
portion to the fund, the petitioners cannot now turn around and
claim that they are employees of the State Government and
therefore, are to be treated on par with the employees of the
State Government for the purposes of grant of pension.
9. Rule 2A and Rule 285 of KCSR is applicable to a
Government servant and not to an employee of an autonomous
institution who have subscribed to the provident fund
constituted by the institution. As rightly contended by the
learned Additional Advocate General, the judgment of the
Division Bench of this Court in W.P.No.8906/2021 c/w
W.P.No.8030/2020 as well as the judgment of Hon'ble Apex
Court in UP Roadways Retired Officials and Officers
referred above are squarely applicable to the facts and

circumstances of this case and the petitioners are not entitled
to be treated as Government servants, in view of Cadre and
Recruitment Rules framed by the respondent No.4.
10. In that view of the matter, the petitioners are not
entitled to any reliefs in this writ petition and hence the writ
petition lacks merits and is dismissed.
