CONTEMPT OF COURTS ACT PRAYING TO PUNISH THE
ACCUSED FOR DISOBEYING THE JUDGMENT OF THIS
COURT IN W.P.H.C. NO.38/2021 DATED 30.06.2021 AND ETC.

THIS DAY, CHIEF JUSTICE MADE THE FOLLOWING:
ORDER
1. Vide our order dated 01.02.2023, non-bailable warrant was
issued to secure the presence of the accused. The warrant is
executed and the accused is present before the Court today.
2. An affidavit dated 16.02.2023 is filed in Court today by the
accused through his advocate. It is stated in the affidavit that this
Court, vide order dated 16.11.2022, directed the accused to
deposit an amount of Rs.1,00,000/- in this Court on or before
24.11.2022. In paragraph 3, it is stated that the accused was
unable to deposit the amount in lumpsum, however, the amount
was deposited in parts through his mother. In paragraph 4, it is
stated that the accused has deposited the balance amount of
Rs.1,00,000/- before this Court by way of Demand Draft and now,
there are no dues.

3. The learned counsel for the accused submits that the
accused is paying Rs.4,000/- per month to the complainant
dutifully. The learned counsel for the complainant admits this
statement. The accused also agrees to pay Rs.4,000/- per month
to the complainant regularly as undertook by him in WPHC
No.38/2021.
4. As the grievance raised in the contempt petition no more
survives and the direction issued by this Court has been duly
complied with, the contempt proceedings are closed. Notice is
discharged.
5. The Registry is directed to encash the Demand Draft amount
of Rs.1,00,000/- and handover the same to the complainant.
