SECTION 397 READ WITH SECTION 401 OF CR.P.C. SEEKING TO
SET ASIDE THE JUDGMENT PASSED BY THE SESSIONS JUDGE
(FAST TRACK), HAVERI, IN CRL.A. NO.45/2007 DATED 24.03.2012
AND SET ASIDE THE JUDGMENT AND SENTENCE PASSED BY THE
JMFC COURT, HANDAL IN C.C. NO.147/2005 DATED 03.09.2007,
                                     2




BY AQUITTING THE PETITIONER/ACCUSED FOR THE OFFENCES
LEVELED AGAINST HIM.

    THIS PETITION COMING ON FOR ORDERS, THIS DAY, THE
COURT MADE THE FOLLOWING:

                             ORDER

On 06.04.2022 bailable warrant is issued against the

petitioner. The same is returned unexecuted with a report of the

Police that "the petitioner is dead". The death certificate of the

petitioner is also produced herein which shows that the petitioner

was died on 30.01.2022.

2. This revision petition is filed by the petitioner against

the conviction and sentence order passed against him by the Trial

Court for the offences punishable under Sections 279 and 304(A) of

the IPC and under Section 134 (a) (b) read with Section 187 of the

M.V. Act.

3. The petitioner has already deposited the fine amount as

on the date of judgment dated 03.09.2007 and the same is

confirmed by the learned counsel for the petitioner.

4. Accordingly, in view of the death of the petitioner, this

revision petition is dismissed as abated.
