        This    Criminal   Revision    Petition   is    filed   under
Section 397 read with 401 of Cr.P.C. p raying to set
aside     the    judgment    and      order   d ated    13.10.2016

passed      by     the    III    Additional          Sessions     Judge,
Shivamogga in Crl.A.No.275/2015 and the judgment
and     order      of    conviction         and       sentence     dated
03.09.2015 passed by the JMFC-II, Shivamogga in
C.C.No.1562/2014           (convicted          for      the      offences
punishab le und er Section 138 of N.I.Act) and acquit
the petitioner of charg es leveled against him.


      This Criminal       Revision         Petition    coming     on   for
hearing this day, the Court made the following:


                                ORDER

Sri Umesh, learned counsel appearing for the

petitioner, submits that the petitioner died on

18.2.2017 and therefore this revision petition has

abated. Sri Sateesh Chandra, learned counsel for

the respondent, produces a copy of the death

certificate of the petitioner. In view of the death

of the petitioner, this revision petition has abated.

It appears that the petitioner deposited

certain sum of money by virtue of the order of this

court dated 1.12.2016. The entire amount :: 3 ::

available in deposit made by the petitioner be

released in favour of the respondent. Send back

the records.
