      This miscellaneous first appeal is filed under Section
173(1) of the M.V.Act, against the judgment and award dated
28.06.2017 passed in MVC No.317/2015 on the file of the
Addl. Senior Civil Judge & Addl. MACT, Ranebennur, awarding
compensation of `1,74,150/- with interest at 7% per annum
from the date of petition till its realization.

      This appeal coming on for Orders, this day the Court
delivered the following:-


                            JUDGMENT

1. Learned Counsel for the appellant has filed a memo

seeking permission of this Court to withdraw the appeal.

2. The aforesaid memo which is countersigned by the

party is taken on record. Appeal is dismissed as

withdrawn.
