      This Miscellaneous First Appeal is filed under Section
19(1) of Family Court Act, 1984, praying to allow the
appeal by set aside the order dated 05.04.2016 passed by
the Prl. Judge, Family Court, Raichur, in Civil
Misc.Case.2/2015, by restoring the divorce petition.

     This appeal is coming on for final hearing, this day,
K.S.Mudagal J., delivered the following:

                       JUDGMENT

Learned counsel for appellant submits memo

reporting that the appellant unfortunately passed away.

The proceedings arise out of the divorce decree passed by

the Family Court in favour of the respondent.

In view of the death of the appellant, the appeal

abates and disposed of accordingly.
