Heard learned counsel representing the petitioners and
learned counsel representing the respondents.
2. In this writ petition, the petitioners have prayed for
direction upon the respondents to consider their case for grant of
benefit of ACP / MACP along with the benefits of 5 th and 6th Pay
Revision. The petitioners have also prayed for direction upon the
respondents for re-computation of their retiral dues including
pension, gratuity and leave encashment on the basis of revised pay
scale along with arrears accruing thereof.
3. Learned counsel representing the petitioners submits that
the petitioners were Erst While employees of "Bihar State Road
Transport Corporation" (in short "BSRTC"), and after the creation of
the State of Jharkhand, the services of the petitioners were absorbed
by the State of Jharkhand w.e.f. 01.07.2004. He further submits that
benefits of ACP / MACP have not been granted to the petitioners. He
also submits that the issue of payment of ACP / MACP to the

employees of BSRTC, who were absorbed by the State of Jharkhand,
has already been set at rest by a Coordinate Bench of this Court in
Cont. Case (Civil) No.247 of 2020 (Shankar Prasad Keshari &
Ors. Vs. The State of Jharkhand & Ors.) and other Analogues
cases [decided on 13.01.2025], arising out of W.P.(S) No.461 of
2018, therefore the petitioners are entitled to get the said benefits.
He submits that similarly situated employees had approached this
Court and their case was directed to be considered by the
respondents. He submits that the respondents had granted the same
benefits i.e. ACP and MACP to those who had approached this Court.
Thus, as per him, the petitioners are forced to approach this Court,
seeking similar reliefs. He lastly submits that the petitioners have
already filed representation and suffice it would, if a direction is given
to dispose the said representation.
4. Learned counsel representing the respondent - State
submits that if the petitioners file their respective representations,
the same will be considered and appropriate order will be passed.
5. Considering the aforesaid submissions of the parties and
the prayer made in this writ petition, I am of the opinion that at the
first instance, it is the respondents who has to decide the claim of
the petitioners. Thus, I direct the petitioners to file their fresh
individual representation before respondent No.2- The Secretary,
Department of Transport, at FAP Building, Dhurwa, Ranchi, within
four weeks from today.
5.1. On receipt of such representation, respondent No.2 will
dispose the same by passing a reasoned order in accordance with

law within a period of six weeks thereafter. A copy of the reasoned
order should be handed over to the petitioners.
5.2. If any part of the claim / representation is rejected, the
reasons thereof should also be communicated to the petitioners.
5.3. The respondent No.2 is also directed to look into this issue
and if the decision of this Court in Cont. Case (Civil) No.247 of 2020
is in rem, he should ensure that all the similarly situated persons will
get the same benefits without they being forced to approach this
Court.
6. With the aforesaid observation and direction, this writ
petition stands disposed of.
