Order No:- 03, Dated:- 25th March, 2026 Heard the parties.

The petitioner has moved before this Court for grant of bail in connection with Deoghar Cyber Crime P.S. Case No. 121 of 2025 registered for the offences punishable under Sections 111(2)(b), 111(3), 111(4), 319(2), 318(4), 338, 336(3), 340(2), 61(2) of the B.N.S. along with Section 66(B) (C) (D), 84 (C) of the I.T. Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in criminal conspiracy with co-accused persons committed Cyber fraud by posing as fake PhonePe Customer Care Officer and by giving false promises of lottery and deceiving gullible persons in the name of providing loans. It is further submitted that from the possession of the petitioner one mobile-phone has been recovered which is used for creation of several e-wallets. It is next submitted by the learned counsel for the petitioner that the allegation against the petitioner is false and charge-sheet has been submitted. It is then submitted that the petitioner has been in custody since 30.08.2025. It is then submitted that the petitioner undertakes to furnish sufficient security including cash security and also undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail.

Learned Addl. P. P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on depositing Rs.2,500/- as cash security and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II -cum- Special Judge, Cyber Crime Cases, Deoghar, in connection with Deoghar Cyber Crime P.S. Case No. 121 of 2025, with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb witnesses of the case in any manner during the trial of the case.
