41/20.03.2026 Reference may be made to order dated 20.02.2026, which
reads as under: -
" Pursuant to the order dated 08.01.2026, Mr. Dwarika Baitha, District Land Acquisition Officer, Bokaro (the opposite party no. 2) is physically present before this Court today.
2. Mr. Ashok Kumar Yadav, learned Sr.S.C.-I appearing on behalf of the opposite parties, while referring to the supplementary show cause affidavit dated 20.02.2026 filed on behalf of the opposite party no. 2, submits that L.P.A. (Filing) No. 700 of 2026 has been filed challenging the order dated 08.01.2026 passed in Civil Review No. 16 of 2025. He, thus, prays for two weeks' time to pursue the said L.P.A.
3. As against this, learned counsel for the petitioners submits that the opposite party no.2 has not yet implemented/executed the order dated 03.08.2023 passed in W.P.(C) No. 4278 of 2020. Otherwise also, the aforesaid L.P.A. challenging the order passed in review jurisdiction is not maintainable. It clearly suggests that the opposite party no. 2 does not intend to comply the aforesaid order passed by this Court in W.P.(C) No. 4278 of 2020 and wants to somehow keep the matter pending so as to deprive the petitioners of the outcome of the said order.
4. Having heard learned counsel for the parties, the opposite party no. 2 is granted three weeks more time by way of last indulgence to comply the aforesaid order, failing which the Court shall proceed against the said opposite party under the provisions of the Contempt of Courts Act.
5. Put up this case under the heading "For Admission" on 20.03.2026.
6. The opposite party no. 2 shall remain physically present before this Court on the next date fixed."
2. Pursuant to the said order, Mr. Dwarika Baitha, District Land
Acquisition Officer, Bokaro (the opposite party no. 2) is physically
present before this Court. A show cause affidavit has also been filed
on his behalf on 18.03.2026. On perusal of the said show cause
affidavit, it appears that the order dated 03.08.2023 passed in
W.P.(C) No.4278 of 2020 has not yet been complied.
3. Learned counsel for the opposite party no. 2 refers to
paragraph nos. 6 and 7 of the show cause affidavit dated 18.03.2026
which reads as under:
"6. That it is humbly states and submitted that however, in compliance of the order dated 03.08.2023, the answering opposite parties wrote letter no. 42 dated 27.01.2026 to the Secretary, Department of Revenue, Registration and Land Reforms, Government of Jharkhand seeking directions from the the department to pay amount the to petitioners which has been deposited by the B.P.C.L. within the government treasury under budget head.
A copy of letter no. 42 dated 27.01.2026 has been annexed as Annexure-A to the said show cause affidavit.
7. That it is further stated and submitted that the answering opposite parties has further sent letter no. 129 dated 11.03.2026 to the Secretary, Department of Revenue, Registration and Land Reforms, Government of Jharkhand stating therein that since B.P.C.L. has deposited the amount with government treasury under budget head, the payment of compensation cannot be made to the petitioners from the Land Acquisition Office and therefore requested to get opinion of the Ld. Advocate General regarding compliance of the order of the Hon'ble court.
Photocopy of letter no. 129 dated 11.03.2026 annexed herewith is and marked as Annexure-B to this show cause affidavit."
4. Considering the content of the letters dated 27.01.2026 and
11.03.2026, let Shree Chandra Shekhar, the Principal Secretary,
Department of Revenue, Registration & Land Reforms, Government
of Jharkhand be arrayed as opposite party no. 4 in the present case.
5. Necessary insertion in the cause title of the present contempt
petition be made by the learned counsel for the petitioners in course
of the day.
6. Issue notice to the newly impleaded opposite party no.4.
7. Mr. Anish Kumar Mishra, A.C. to Sr. S.C.-I, appears and waives
notice on behalf of the said opposite party.
8. Opposite party no. 4 is directed to file show cause affidavit
within three weeks.
9. Put up this case on 17.04.2026 under the heading "For
Admission".
10. In the meantime, let the notice in Form-I read with Rule 393
of High Court of Jharkhand Rules, 2001 be issued against the
opposite party nos. 2 and 3, requisites etc. must be filed within a
week.
11. Opposite party nos. 2 and 3 are also directed to file respective
show cause affidavits as well as they shall remain physically present
before this Court on the next date fixed unless the aforesaid order of
this Court is compiled before the said date.
