02/19.03.2026 Heard Mr. Baibhaw Gahlaut, learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is an accused in connection with S.T. Case No. 286 of 2025, arising out of Chira Chas P.S. Case No. 78 of 2025.

It has been alleged that the daughter of the informant died at her matrimonial house and suspicion was cast upon the petitioner who is the husband of the deceased.

It has been submitted by the learned counsel for the petitioner that the petitioner was admitted at 'Serenity Foundation' which is a rehabilitation Centre prior to the commission of suicide by his wife. Learned counsel submits that as per the postmortem report the cause of death has been ascertained to be asphyxia due to hanging. It has been submitted that the petitioner is in custody since 30.05.2025.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

The evidence of the witnesses as has been collected in course of investigation suggests that the petitioner used to regularly assault the deceased after being in a drunken condition. The continuous and persistent assault and mental torture committed by the petitioner upon the deceased led her to commit suicide and, in such circumstances, I am not inclined to grant bail to the petitioner. The same is hereby rejected.
