State Counsel as they are in the process of complying the order.
2. Mr. Manoj Tandon, learned counsel appearing for the
petitioner submits that pursuant to quashing of the impugned
order of punishment the petitioner was also entitled for promotion
and in view of the judgment passed by Hon'ble Apex Court in the
case of K. Samba Moorthy Vs. Sanjiv Chadha and Others reported
in 2025 SCC OnLine SC 172, it is evident that the benefit of
promotion is covered in the expression consequential benefits.
Since this Court after quashing of the impugned order of
punishment has categorically directed that the consequential
order shall be passed; as such, he is also entitled for promotion to
the post of S.D.M/A.D.M.
3. Accordingly, learned counsel for the State is directed
to ensure that the order passed by this Court is complied in true
letter and spirit.
4. List this case on 20.01.2026.
