In view of the objections raised by the stamp reporter that since the appeal has been filed after the expiry of maximum period of 180 days, the appeal is barred under Section 14A (3) Second Proviso; which envisages that no appeal shall be entertained after the expiry of 180 days.
Learned counsel for the appellant relies upon the judgment of the Hon'ble Full Bench of Allahabad High Court in Criminal Appeal No.1000 of 2018 dated 28.07.2022 headed by Hon'ble Rajesh Bindal (Chief Justice) as his Lordship then was; wherein it has been mentioned that the Full Bench of the Hon'ble Allahabad High Court In Re: Provision of Section 14A of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015, struck down the second proviso of Section 14A (3) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989; being violative of Articles 14 and 21 of the Constitution of India.
In view of the same, the defects pointed out by the stamp reporter is overruled.
