This bail application has been filed on behalf of Pammi Singh @ Avinash Kumar Singh who is in custody since 26.06.2025 in connection with Lesliganj P.S. Case No. 86 of 2025 for the offence registered under Sections 65(2) of the BNS and under Section 6 of the POCSO Act, pending in the Court of learned Exclusive Special Judge (POCSO), Palamu at Daltonganj is pressed into motion.

The matter involves the allegation of penetrative sexual assault with a minor child, three years of age.

It is submitted by learned counsel for the petitioner that the medical evidence does not corroborate the allegation of penetrative sexual assault as no injury was found in and around perineum. Had the child been sexually abused, considering the age, there must have been some injury but no external injury mark was found on her body.

Learned counsel for the State has opposed the prayer for bail and submitted that the vaginal swab taken, anal swab taken, has been sent for forensic science laboratory and the report has not so far been received.

Under the circumstance, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected at this stage.
