04/03.02.2026 Heard learned counsel appearing for the petitioner as well

as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with

Chhattarpur P.S. Case No.201 of 2025, for the alleged offences

registered under Sections 191(2), 191(3), 190, 126(2), 127(2),

115(2), 117(2), 109(1), 352 and 351(2) of Bharatiya Nyaya Sanhita,

2023 pending in the Court of learned J.M.F.C., Palamau at

Daltonganj.

3. Learned counsel appearing for the petitioner submits that

there are case and counter case between the parties and the only

allegation is made against the petitioner that the petitioner was

standing there with a pistol. He further submits that there are

general and omnibus allegation against all the accused persons of

assault. He then submits that the petitioner has got no criminal

antecedent as disclosed in paragraph No.17 of the petition.

4. Learned counsel appearing for the State opposes the prayer

and submits that the allegations are there against the petitioner of

standing there with a pistol.

5. Looking into the contents of the FIR it transpires that only

on the last portion of the FIR the allegations are made against the

petitioner of standing with pistol and there are general and omnibus

allegation against all the accused persons of assault and the

petitioner has got no criminal antecedent as disclosed in paragraph

No.17 of the petition and there are case and counter case between

the parties, I am inclined to provide anticipatory bail to the

petitioner.

6. Accordingly, the petitioner, above named, is hereby directed

to surrender before the learned Court within three weeks from

today, and in the event of his surrender/arrest, the petitioner, above

named, shall be released on bail, on furnishing bail bond of

Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of

the like amount each, to the satisfaction of learned J.M.F.C.,

Palamau at Daltonganj in connection with Chhattarpur P.S. Case

No.201 of 2025, subject to the conditions as laid down under

Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
