04/02.02.2026 I.A. No 12311 of 2025

1. The instant Interlocutory Application has been filed on behalf of the appellants for condoning the delay of 21 days.

2. Learned counsel for the appellants has submitted that appellants are police officials and they were posted at remote places and as such they were not aware of the impugned order dated 14.05.2025 and due to the said reason the appeal could not be filed within time and hence the delay of 21 days in filing the appeal may be condoned.

3. Learned A.P.P. has raised no objection.

4. However, learned counsel for the Respondent No.2 has opposed the delay and has submitted that the delay of 21 days in filing this appeal on the part of the appellants is deliberate and the explanation for the delay is also not cogent.

5. Having heard learned counsel for the appellants and considering the averments made at Para 5, 6 and 7 of the Interlocutory Application, the delay of 21 days in filing this appeal is condoned.

6. Thus, the I.A. No 12311 of 2025 is allowed and stands disposed of. Criminal Appeal (S.J.) No. 880 of 2025

7. Call for the legible scanned copy of the Lower Court Record, including F.I.R, Final Form as well as neatly typed copy of the Case Diary and the Protest-cum-Complaint Petition.

8. Put up this case after Four (04) weeks.
