Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 302/201/34 IPC in connection with Giridih (M) PS Case No. 330 of 2023.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that the petitioner has no criminal antecedent and co-accused namely, Bhutulal Marandi in B.A No. 4467 of 2024 has been granted bail on 27.08.2024 by the Co-ordinate Bench of this Court. He submits that the petitioner is in custody since 02.11.2023 as such the petitioner may be enlarged on bail.

4. Learned APP opposes the prayer for bail of the petitioner.

5. Having regard to the allegation made against the petitioner coupled with the fact that co-accused in B.A No. 4467 of 2024 has been granted bail by the Co-ordinate Bench of this Court and the petitioner is in custody since 02.11.2023, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Giridih in connection with Giridih (M) PS Case No. 330 of 2023.

6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any

witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

7. Accordingly, the instant bail application stands allowed.
