02/26.02.2026 I.A. No. 1572 of 2026 Heard the learned counsel for the respective parties. This application has been preferred by the appellant for condoning a delay of 12 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 12 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

This appeal is directed against the order dated 16.12.2025 passed in B.P. No. 1108/2025 arising out of Dhanbad GRPS Case No. 124/2025 by the learned Additional Sessions Judge-I, Dhanbad, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been submitted by Mr. Kalyan Banerjee, the learned counsel for the appellant that in similar circumstances one of the co- accused who was also apprehended at the spot namely Puran Ravidas has been granted bail by a co-ordinate Bench of this Court in Cr. Appeal (DB) No. 1628 of 2025. It has further been submitted that the appellant is in custody since 11.11.2025.

Learned A.P.P. has opposed the prayer for bail of the appellant but does not dispute the fact that the case of the appellant stands on similar footing to that of the co-accused who has been granted bail by a co-ordinate Bench of this Court.

Regard being had to the above, we while setting aside the order dated 16.12.2025 passed in B.P. No. 1108/2025 arising out of Dhanbad GRPS Case No. 124/2025 by the learned Additional Sessions Judge-I, Dhanbad direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Railway, Dhanbad in connection with Dhanbad GRPS Case No. 124/2025.

This appeal is allowed.
