1. This appeal under section 19(1) of the Family Courts' Act is directed against the judgment passed by the learned Family Judge, Ranchi.
2. Learned counsel for the respondent-wife, at the outset, has vehemently submitted that by seeing the conduct of the appellant, on one hand, the respondent-wife is having no means of survival, while on the other hand, even after passing the order of maintenance by the learned Family Judge, Ranchi in exercise of power under Section 124 Cr.P.C., the maintenance amount is not being paid. It has been submitted that due to non-payment of amount of maintenance, the respondent-wife is not in a position to survive and as such, the appellant-husband needs to show his bona-fide for payment of the amount of maintenance. The arrear thereof has become around Rs.15.00 lakhs

Mr. Ritesh Kumar, learned counsel appearing for the appellant- husband has submitted that so far as the amount of maintenance which was directed to be paid to the son is concerned, the same has been paid. It has been further submitted that so far as the maintenance amount directed to be paid in favour of the wife is concerned, Revision Application was filed and this Court has passed an order of ad-interim stay.
4. Copy of the order dated 13.08.2024 passed in Cr. Revision No.1270 of 2023 has been placed for perusal.
5. Refuting the same, the learned counsel appearing for the respondent-wife has submitted that the said Criminal Revision No.1270 of 2023 has already been dismissed vide order dated 13.08.2024. Therefore,
question of the interim stay does not arise after dismissal of the Criminal Revision.
6. This Court is adjourning the matter today and posting the same on 16.04.2026 with a direction to the appellant -husband to show bona-fide by making payment of the arear of the amount, failing which this Court will be compelled to issue distress warrant against him.
7. List on 16.04.2026 for passing further necessary order.
8. Both the parties are directed to file affidavit showing the details of the income movable or immovable. The learned counsel for the appellant is directed to file statement of account including the pay slip of the appellant.
9. It has been reported that the respondent is presently residing in Darbhanga District in the State of Bihar and as such, it has been submitted that she having no means of income, will have to meet her own expenditure towards travelling and other expenses. Considering the same, this court directs the appellant to pay Rs. 11,000/- to the respondent wife on the next date of hearing.
